1. Introduction

By enrolling in or participating in our Lindberg Loyalty Program (the "Program"), you expressly consent to be bound by these Loyalty Program Terms of Service (the "Program Terms"), including any updates or amendments made hereto, as well as our general Terms of Service and Privacy Policy, each found at https://www.lindbergnutrition.com/policies/terms-of-service and https://www.lindbergnutrition.com/policies/privacy-policy. Should you disagree with any part of these Program Terms, our general Terms of Service or our Privacy Policy, your sole recourse with respect to the Program is to discontinue participation in the Program.

You acknowledge and agree that by using our Services (including email, phone, or SMS), you are a customer of Lindberg under all applicable federal and state laws, including the Texas Business and Commerce Code, and  Lindberg is relying on your consent herein to provide you our Services.

2. Eligibility Criteria

Program participation is contingent upon (i) being at least 18 years of age and (ii) maintaining an active account (as discussed in Section 3 herein) with Lindberg. Program, and Program Rewards (defined below), are void where prohibited by law or any other regulatory framework. You are responsible with confirming your eligibility of Program will not violate any applicable law or regulation.

3. Program Mechanics

After Program enrollment, participants will accrue points and/or rewards (collectively "Rewards") based on qualifying activities, which include, but are not limited to, purchases, referrals, and specific promotional actions, as further detailed on our Program’s information page, available at https://www.lindbergnutrition.com/pages/rewards. The accrual, redemption, and specifics of these Rewards are subject to change at our discretion, with or without notice, in line with the Program's structure and objectives as posted on our site. Please note that any Rewards accumulated will expire after twelve (12) months of inactivity with us (i.e. from the date of the last order placed).

4. Non-Transferability of Rewards

Program Rewards are non-transferable and may not be exchanged for cash or other substitutes unless specifically permitted hereunder. The sale, barter, transfer, or assignment of any accumulated Rewards, other than by us, is expressly prohibited.

5. Restrictions

Program participants may not engage in any fraudulent or abusive activities aimed at unjustly accumulating Rewards. Such activities include, but are not limited to, creating multiple accounts for the same individual or engaging in deceptive practices to generate referrals. We reserve the right to monitor accounts for suspicious activity and may adjust Rewards or terminate accounts accordingly.

6. Program Adjustments

We retain the right to modify, pause, or terminate Program at any time, with or without prior notice, for any reason we deem appropriate. This includes changes to Program structure, rewards, and eligibility criteria. Program participants will be informed of significant changes through updates to these Terms or other direct communications.

7. Limitation of Liability

Our liability in connection with Program, including tiers and Rewards, are limited to the extent permitted by law. We are not liable for any errors or omissions in the administration of the Program, including but not limited to, errors in the allocation of Rewards to Program participants.

8. Jurisdiction and Governing Law

These Terms, and any dispute arising from the interpretation or application of these Terms, shall be governed by the laws of the state of Delaware. Participants agree to submit to the exclusive jurisdiction of the courts located within Wilmington, Delaware (or the greater New Castle County) for the resolution of all disputes regarding Program, including with respect to any Rewards.

Program participants are encouraged to contact customer service through our website for questions and concerns regarding these Program Terms or the Program.

Enrollment and/or participation in Program constitutes acknowledgment and acceptance of these Terms, which participants affirm to have read and understood prior to such enrollment and/or engagement. It remains the responsibility of each participant to read and understand these Program Terms herein and any amendments thereto.
